These Terms and Conditions govern the use of the Hotel.eu platform. By accessing or using the Service, you agree to be bound by these Terms. Hotel.eu is operated by Hotel.eu B.V., acting as a Software-as-a-Service (SaaS) provider. Any deviations from these Terms are only valid if confirmed in writing by Hotel.eu.
Article 1 – Definitions
1.1 Provider – The natural or legal person offering accommodations or tourism-related services through the Hotel.eu platform.
1.2 User – The natural or legal person who accesses and uses the Service.
1.3 Account – The personal online account created by a User to access and manage the Service.
1.4 Service – The online platform operated by Hotel.eu for discovering and comparing accommodations, tourism services, and local products.
1.5 Agreement – The contractual relationship between the User and Hotel.eu governing the use of the Service.
1.6 Website – The Hotel.eu website, including all subdomains and extensions.
Article 2 – Use of the Service
2.1 Hotel.eu provides an online platform enabling Users to discover accommodations, tourism services, and local products and to connect with Providers.
2.2 Hotel.eu is not a party to any agreement concluded between Users and Providers. The platform acts solely as an intermediary.
2.3 Access to the Service requires the creation of an Account.
2.4 Users are responsible for maintaining the confidentiality of their Account credentials and for all activities conducted under their Account.
2.5 Reviews may only be submitted by Users who have actually booked with a Provider. Hotel.eu reserves the right to remove misleading, fraudulent, or inappropriate content.
Article 3 – Rules of Use
3.1 The Service may not be used for unlawful purposes, including the publication of defamatory, discriminatory, misleading, or otherwise unlawful content.
3.2 Users may not reproduce, rent, sublicense, or commercially exploit the Service without prior written consent from Hotel.eu.
3.3 Hotel.eu reserves the right to suspend or terminate Accounts and remove content in the event of violations of these Terms.
Article 4 – Complaint Procedure
4.1 Complaints relating to accommodations or services provided by Providers must be addressed directly to the relevant Provider. Hotel.eu is not a party to such agreements.
4.2 In the event of repeated violations of these Terms by a User or Provider, Hotel.eu reserves the right to restrict or terminate access to the Service.
Article 5 – Promotional Platform
5.1 Hotel.eu operates as a promotional and discovery platform and does not participate in contractual relationships between Users and Providers.
5.2 Hotel.eu does not guarantee the accuracy, completeness, or availability of information provided by Providers.
5.3 Providers may apply their own terms and conditions to bookings and services. Users are responsible for reviewing such terms before entering into any agreement.
Article 6 – Payments and Cancellations
6.1 All payments for accommodations or services are made directly between the User and the Provider. Hotel.eu does not process payments and is not involved in financial transactions.
6.2 Cancellation policies are determined by Providers. Hotel.eu is not responsible for refunds, cancellation fees, or disputes relating to payments.
Article 7 – Availability and Maintenance
7.1 Hotel.eu aims to ensure optimal availability of the Service but does not guarantee uninterrupted access.
7.2 The Service may be temporarily unavailable due to maintenance, updates, or technical improvements.
Article 8 – Intellectual Property Rights
8.1 All intellectual property rights relating to the Service and its content belong to Hotel.eu and/or its licensors.
8.2 Users retain ownership of the content they submit but grant Hotel.eu a non-exclusive, worldwide license to use, display, and distribute such content as part of the Service.
Article 9 – Liability
9.1 Hotel.eu is not liable for any damages arising from agreements concluded between Users and Providers.
9.2 While Hotel.eu strives for accuracy, it is not liable for errors or omissions in platform content unless caused by gross negligence or willful misconduct.
9.3 Hotel.eu’s total liability is limited to a maximum of EUR 250 per incident.
9.4 Hotel.eu is not liable for indirect or consequential damages, including loss of profit.
Article 10 – Privacy and Data Protection
10.1 Hotel.eu processes personal data in accordance with applicable data protection laws and its Privacy Policy available on the Website.
10.2 Personal data will not be shared with third parties unless necessary for the operation of the Service or required by law.
10.3 Users have the right to access, correct, and delete their personal data in accordance with applicable legislation.
Article 11 – Applicable Law and Contact Information
11.1 These Terms and Conditions, and any Agreement arising from them, are governed by and construed in accordance with French law.
